General Terms and Conditions (GTC)

§ 1 Scope

These General Terms and Conditions are part of all contracts between you and TRADEFOOX (“we,” “us,” or “TRADEFOOX”) regarding products and services from TRADEFOOX (hereinafter referred to as “TRADEFOOX Services”). Opposing terms and conditions do not apply, even if we do not explicitly object to them. By placing an order, you confirm that you are a business entity within the meaning of the German Commercial Code (HGB).

§ 2 Definitions and Order Content

The content of your order for listing your company on our platform is based on the information and selected services you provide in your customer area. The design and sorting of your company profile comply with the current specifications in your customer area. We reserve the right to adjust these specifications without this resulting in any reduction or termination rights.

§ 3 Order Placement and Duration

You can place an order with us in writing, electronically, or by phone. All orders are standing orders and automatically renew for 12 months unless they are canceled with a notice period of three months before the end of the contract period. Additional services run until the start of the next renewal period of the main order.

§ 4 Payment Processing (PayPal and Stripe)

1. Payments are made exclusively via the payment methods we accept, particularly PayPal and Stripe.
2. By using PayPal and Stripe, you accept their terms and privacy policies. PayPal and Stripe are independent payment service providers, so we assume no liability for their actions or security risks.
3. In the event of payment reversals or unauthorized transactions, we are entitled to block your account and claim outstanding amounts.
4. All prices are exclusive of the applicable statutory VAT. Unless otherwise agreed, payments are due immediately.

§ 5 Refunds and Cancellations

1. Refunds are granted at our discretion unless there is a legal entitlement. Fees incurred through PayPal or Stripe will not be refunded.
2. If there is suspicion of abuse or fraud, we reserve the right to deny refunds.

§ 6 Contract Termination and Account Suspension

1. We are entitled to block your account or terminate the contract without notice if you violate these GTC, applicable laws, or the terms of use of PayPal or Stripe.
2. In case of termination, all payment obligations due up to that point remain in effect.

§ 7 Liability and Warranty

1. We are only liable for damages resulting from intentional or grossly negligent breaches of duty.
2. Liability for indirect damages, lost profits, or data loss is excluded.
3. PayPal and Stripe are independent companies. We assume no liability for errors or delays in their payment systems.

§ 8 Data Protection

1. Information about how we process your personal data is set out in our Privacy Policy. Where the law requires separate consent (for example for optional cookies or advertising), we will ask for it explicitly; continued use of our services alone does not replace that consent.
2. For payments via PayPal or Stripe, data will be transmitted to these providers according to their privacy policies.

§ 9 Final Provisions

1. The law of the Federal Republic of Germany applies.
2. The place of fulfillment and jurisdiction is the registered office of TRADEFOOX.
3. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
